A Planning meeting was held on 2nd May 2017 at 6.30pm in the Baldersby Mission Room Village Hall.  In attendance were Chris Brown, Colin Reid, Jeannie Wright, Stuart Carter and Vicky Shaw.  There was also one member of the public.  Apologies had been received from John Hart.  Chris Brown explained to the member of the public that they were sitting as a Parish Planning Meeting.

All Parish Councillors had previously seen the Planning documents.  The application was discussed and Decision B was proposed by Stuart Carter and seconded by Jeannie Wright.  This was voted on – all were in favour.  Parish Clerk Vicky Shaw completed the form and signed and dated it.  Parish Clerk scanned and emailed the document later that same evening and also posted the original on 3rd May 2017.


DECISION B – The Parish Council objects on the planning grounds set out:

The Parish Council notes that this is a Prior Notification of application, from the applicant’s agent, for change of use from agricultural building to flexible commercial use.  The Parish Council is of the view that, as this building was erected and brought into use after 3rd July 2012, the Town and Country Planning (General Permitted Development) (England) Order 2015, states that certain criteria need to be met:-

  • -The subject building needs to have been in solely agricultural use on the 3rd July 2012 or when it was last in use if now redundant.   If erected/brought into use after 3rd July 2012 maintains that use for a period of ten years.

Thus the Parish Council understands that the criteria mentioned above, is not met.  If a planning application is forth-coming , the Parish Council will have no option but to object strongly. 

When permission for the agricultural building was originally applied for (Application number 6.11.89.C.FUL  13/04545/FUL) December 2013, the Parish Council objected  to it being built, - it was allowed to be built after an appeal.

The Parish Council would also like to state that this present building was purpose built for modern agricultural usage, and there is a known local demand from the agricultural community for such buildings.

Jeannie Wright handed Vicky Shaw a cheque for £50 as a donation from a resident of Baldersby to go towards the cost of the defibrillator.

Declaration of Interest – Chris Brown declared an interest in Village Farm in that his wife was the previous owner of the property.  This planning permission being discussed is from the new owners.

Border Cot was discussed first.  This is a revised scheme and the application asks permission to build the house out of brick rather than stone and have blue slates on the roof.

The Parish Councillors decided on DECISION A – The Parish Council has no objections.  This was a unanimous decision.

Chris Brown left the meeting before the application for Village Farm was discussed.

Village Farm - The new plans were looked at in detail and discussed.  The Parish Councillors decided on DECISION C – The Parish Council does not object to or support the application but wishes to make comments or seek safeguards as set out overleaf.

The Parish Council wishes to make the comment that the revised proposal seems to change the streetscape in respect of the orientation of the houses, and, as a result, it is not as aesthetically pleasing as it was.

This decision was unanimous.

Decision B – The Parish Council objects on the planning grounds that this development is adjacent to an existing conservation area and in particular is directly opposite a number of listed buildings.  We consider that this development, while attempting to be sympathetic will have a detrimental effect on the appearance and atmosphere of this historically important village. The Parish Council objects on the planning grounds that this proposed development, which abuts the conservation area, will have a significant impact on the Conservation Status of Baldersby St James. This Conservation Status was approved on 16th November 2011 by the District Council following a protracted Public Consultation exercise involving specialists from the Conservation Area Department of the Council, the Parish Council and local residents from the Parish. The Parish Council continues to support the Conservation Status of Baldersby St James which has 18 listed buildings and has been described as a jewel in the crown of Harrogate district.

The Parish Council would strongly advise the Planning Officer to contact The Victorian Society, the Council of Protection of Rural England and English Heritage regarding Baldersby St James, before making any decision about this application.

Parish Clerk completed the form and signed and dated it. It was emailed to HBC Planning department on 7th January 2016 and also a copy posted.

The Parish Councillors went with DECISION C (proposed by John Hart and seconded by Stuart Carter) All Councillors were in favour of Decision C – The Parish Council does not object to or support the application but wishes to make comments or seek safeguards as set out below:

  • 1.The Parish Council raises the question - is planning permission needed for the formation of a pond? There is no mention of the pond in the plans and the Parish Council would like clarification.
  • 2.The Parish Council would like to point out that the creation of a significant pond has changed the appearance of the landscape significantly and arguably creates a hazard to escaped livestock and the public which did not exist before. Also the Parish Council raises the question - is there a requirement for a change of use from agricultural to recreational use?
  • 3.The Parish Council is very aware that the land does indeed flood (as it has done last Saturday – after the application has been submitted). The Parish Council would like to ensure that no hazardous or polluting products are stored in the hut.
  • 4.The Parish Council is not happy that this is a retrospective planning application.
  • 5.The Parish Council requests that the hut owner is required to plant up around the hut to soften the look of the installation.

Chairman John Hart explained the process to the members of the public. He said that a letter had been received from Tim Helps. He asked Tim Helps to precis his letter. Other members of the public were asked to express their own views. Everyone who spoke was in favour of some sort of development on the site however expressed views included: Too many houses on the site, wrong sort of house, concerns about parking, number of cars, garaging and potential congestion within the village, access/visibility/safety concerns regarding the A61, privacy issues, aesthetics of the building, site management issues re Contractors and potential mud on A61/safety issues, effect on the infrastructure in the village especially re Broadband and sewerage.

1.Are there adequate parking spaces for the number of houses to be built? The Parish Council would want reassurance that there is enough parking for residents and visitors. The village already has severe issues with parking.

2.What will be the effect on the village while construction is being undertaken especially concerning Contractor parking and resulting mud on the A61 and footpaths?

3.Will the village infrastructure be able to cope in terms of Broadband and sewerage, taking into account this proposed development as well as the other recently approved developments in the village.

4. With regards to access and egress onto the A61, the Parish Council would like the view from Highways as to the suitability and safety of the development.

The meeting was attended by CB,SC,JW,JH, CR and VS plus two members of the public. A site visit was undertaken and a proposal was made by Chris Brown, seconded by Jeannie Wright to go with Option B – The Parish Council objects on the planning grounds set out overleaf.

The Parish Council does not feel that there is any NEW evidence to justify the granting of this application and therefore wishes it to be refused on the following grounds:

  • 1.The site has been the subject of a number of previous planning applications and they have always been refused. The original reasons for refusal still remain.
  • 2.When the previous application was refused in 2010, the reasons for the decision included – the proposal would result in the formation of a new dwelling in the open countryside. The proposal would also be detrimental to the rural setting of the village. The Parish Council support the view that the open aspect of the village should be retained.
  • 3.The area in question is not a paddock, but part of a field which is agricultural land and the fence can be easily removed.
  • 4.The application is on open space beyond the main built up confines of the village and would result in the loss of Grade 2 agricultural land.
  • 5.Access would mean removing a large part of an important hedgerow.
  • 6.The Parish Council has concerns that by allowing this application more building would follow and set a precedent on this field.

The proposal was voted on and was unanimous.
